US Patent Office Says AI Can’t Own Ideas

Nowadays, AI is leading the aspect of technology, and it is said to be in the development phase, but still, it is powerful in doing several tasks that can be done by humans with more efficiency. Due to this, there are several new problems, like sometimes not being able to recognize if any particular work is done by AI or humans, so here comes the US patent office, which denies the patent approval for the AI-powered inventions.

According to the information, the agency has listed a guideline that properly describes the terms and conditions for filing the patent. It clearly states that it will not support the AI-powered invention for the patent. It has also been clarified that if a person uses AI, they generally will not be precluded from filing a patent, but before submitting the application, they have to disclose if they used AI in the invention process.

However, to be able to get the patent, the person who used the AI should contribute signification to the invention conceptions. For example, if someone asks AI to create anything with a simple command, then it will be totally disqualified.

“However, a significant contribution could be shown by the way the person constructs the prompt in view of a specific problem to elicit a particular solution from the AI system,” the USPTO says. 

For your clarity, in 2020, the US Patent Office will issue a rule saying only “natural humans” can apply for patents, according to researcher Stephen Thaler. Thaler added the AI system he created, DABUS, as an inventor in a patent application. A US court upheld the patent office’s decision. A different federal court ruled that AI systems cannot be granted copyright, following a separate application by Thaler involving an AI-generated image.
